My name is Paul Murphy and I specialize in guiding U.S.
recreational vehicles (RV's), specialty vehicle and trailer
manufacturers through the process. I give you access to
the experience and knowledge needed to assist in organizing your
compliance program and packages to meet Transport Canada's needs
and enter the Canadian market. . In
reality, this is the same information that is required and can
be requested by the U.S. regulatory authority, The NHTSA (National Highway Traffic Safety Administration).
Both the U.S. and Canadian Motor Vehicle Safety Acts require motor vehicles and regulated items of motor vehicle equipment manufactured for sale be certified as compliant with all applicable Canadian Motor Vehicle Safety Regulations ("CMVSR") and Canadian Motor Vehicle Safety Standards ("CMVSS") by the manufacturer or alterer. Type approval is not applicable for motor vehicles and motor vehicle equipment sold. Instead, a “self-certification” process is in place, which requires the manufacturer to certify the vehicle or equipment as complying with the applicable CMVSS. The Vehicle Safety Act requires the exercise of “reasonable care” in issuing the certification of compliance with safety standards. The only way to exercise that reasonable care is to confirm compliance with the applicable standards by testing where included and maintain that confirmation through an ongoing compliance program.
As a manufacturer exporting your product to the Canadian market you need to confirm 3 things;
1) That you as a manufacturer/convertor have an active and ongoing compliance program in place to self-certify your products,
2) That you have current and appropriate documentation and testing to support your declaration of compliance to the applicable CMVSS (Canadian Motor Vehicle Safety Standards), and
3) That you have the ability to initiate and manage product recalls if required.
